The law provides for revision of any order issued by the Union government against any person registered under the Act.
“Since November, 2021 the FCRA certificate of Public Health Foundation of India, New Delhi, and Missionaries of Charity, Kolkata, was renewed by way of revision,” minister of state for home Nityanand Rai said in a written reply in the Lok Sabha.
He said that FCRA registrations were not cancelled but “about 5,800 FCRA registered associations had not submitted their applications for renewal within stipulated time in accordance with the provisions of the FCRA 2010”.
“FCRA registration of these associations has thus been deemed to have ceased as per section 12 of the Foreign Contribution (Regulation) Act, 2010, read with rule 12 of the Foreign Contribution (Regulation) Rules, 2011,” said Rai. “In view of Covid-19 pandemic, the Centre has granted relaxations for validity of registration certificate of NGOs (non-government organisations) expiring between September 29, 2020 to December 31, 2021 had been extended up to March 31, 2022”
Similarly, the deadline for filing annual returns for 2019-20 was extended by six months while FCRA associations were allowed to receive foreign contributions in their old main FCRA account up to June 30, 2021. Several NGOs whose FCRA accounts were deregistered had approached the Supreme Court seeking relief. However, on January 25, the apex court declined to give any interim relief.
